By accessing or using MindspanDashboard ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Platform. Your continued use of the Platform following any changes to these Terms constitutes acceptance of those changes.

2. Platform Description

MindspanDashboard is an educational and self-guided wellbeing platform. It does not provide clinical diagnoses, establish a therapist-client relationship, or replace professional mental health care. All content is for educational and self-reflection purposes only.

Intended use: Self-guided educational wellbeing platform with AI-assisted pattern identification for young men aged 18-34 experiencing adjustment difficulties.

TGA classification: Class I — Low-risk educational decision support.

The Platform is not intended for:

• Clinical diagnosis of mental health conditions
• Crisis intervention or emergency response
• Medication recommendations or pharmaceutical advice
• Replacement of professional mental health care
• Use by persons under 18 years of age
• Couples, family, or group therapy
• Severe psychiatric conditions requiring inpatient care

3. No Therapeutic Relationship

Use of MindspanDashboard does not establish a clinician-client, therapist-patient, or any other professional therapeutic relationship. The platform provides self-guided educational tools and AI-assisted pattern identification, not clinical care.

You expressly acknowledge that no clinician-client, therapist-patient, counsellor-client, or any other form of professional therapeutic relationship is created by your use of the Platform. The educational content, AI-generated insights, and self-reflection tools provided do not constitute professional mental health care.

4. No Diagnosis

The information provided is educational in nature and designed to support your personal wellbeing journey. It is based on established clinical frameworks (DSM-5-TR, ICD-11) used as reference models, not as diagnostic tools. This information should not be used as a substitute for professional clinical advice, assessment, or treatment.

The Platform does not diagnose mental health conditions. References to clinical frameworks such as the DSM-5-TR and ICD-11 are used as educational reference models only. Only a qualified, registered mental health professional can provide a clinical diagnosis. Any pattern identification or clinical framework alignment presented by the Platform is for educational self-reflection purposes and must not be interpreted as a formal diagnosis.

5. AI-Generated Content

AI-generated insights are produced by machine learning models and may contain inaccuracies. They are intended as educational decision support only and must not be relied upon as clinical advice. All AI output is reviewed against established clinical frameworks but is not validated by a clinician for individual cases.

You acknowledge that AI-generated content is produced by machine learning models, may contain errors or inaccuracies, and is provided for educational and self-reflection purposes only. AI output does not constitute clinical advice, diagnosis, or treatment recommendations. Your de-identified data is processed by AI systems; personal health information (PHI) is scrubbed before transmission to AI providers.

6. Not a Crisis Service

7. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are 18 years of age or older. The Platform is designed primarily for Australian residents and operates under Australian law. Users outside Australia may access the Platform but do so subject to these Terms and Australian regulatory requirements.

8. User Responsibilities

As a user of the Platform, you agree to:

• Provide honest and accurate responses to assessments and self-reflection tools, as the quality of insights depends on the accuracy of the information you provide.
• Seek professional mental health support when your wellbeing requires it, particularly if assessment results suggest significant distress.
• Not use the Platform as your sole source of mental health or wellbeing support.
• Contact emergency services (000) or Lifeline (13 11 14) if you are in crisis or immediate danger.
• Keep your account credentials confidential and notify us promptly of any unauthorised access.
• Not attempt to reverse-engineer, disassemble, or interfere with the Platform's systems or security measures.

9. Intellectual Property

All content, design, code, logos, trademarks, and intellectual property associated with MindspanDashboard are owned by or licensed to MindspanDashboard and are protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any Platform content without prior written consent.

You retain ownership of the personal data and assessment responses you provide. By using the Platform, you grant us a limited licence to process your data as described in our Privacy Policy.

10. Data & Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information.

Your data is encrypted (AES-256), de-identified before AI processing, and stored in compliance with the Australian Privacy Act 1988 and HIPAA standards.

11. TGA & Regulatory Compliance

TGA classification: Class I — Low-risk educational decision support.

This platform is not registered on the Australian Register of Therapeutic Goods (ARTG) and is not intended to function as a therapeutic good or medical device. It provides educational decision support only.

The Platform operates as educational decision support software. It does not meet the definition of a medical device under the Therapeutic Goods Act 1989 and is not registered on the Australian Register of Therapeutic Goods (ARTG). The Platform does not diagnose, treat, prevent, or cure any disease or condition.

12. AHPRA & APS Compliance

The design, content, and operation of this Platform adhere to the principles and standards set out in:

These compliance references reflect our commitment to ethical, transparent, and responsible operation. The Platform does not provide regulated health services and its operators are not required to be registered with AHPRA. However, platform design principles align with these professional standards to ensure user safety and ethical conduct.

13. Limitation of Liability

To the maximum extent permitted by Australian law, MindspanDashboard, its operators, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of or inability to use the Platform.

Without limiting the foregoing, the Platform is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of any content, AI-generated output, or assessment results. You acknowledge that any reliance on such content is at your sole risk.

Nothing in these Terms excludes or limits any consumer guarantees or rights that cannot be excluded under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010).

14. Indemnification

You agree to indemnify, defend, and hold harmless MindspanDashboard, its operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) any content or data you submit to the Platform.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through the Platform (for example, via a notification banner or updated consent gate). Your continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Australia. You agree to submit to the exclusive jurisdiction of the courts of Australia for the resolution of any disputes arising out of or in connection with these Terms or your use of the Platform.
